“I hope that both the legislative and judicial branches of government would join us in strengthening our democratic institutions by following suit and instituting measures that would allow unfettered public access to relevant information about their affairs, subject to reasonable restrictions and regulations in exceptional circumstances. It is by ensuring accountability in public service through an informed citizenry that we can truly realize the constitutional tenet that indeed, ‘sovereignty resides in the people and all government authority emanates from them.” Ito ang mensahe ng Pangulong Rodrigo Duterte sa kanyang speech sa Freedom of Information Week.
Matatandaang mabilis na nilagdaan ng Pangulong Duterte ang isang Executive Order o EO na nagpapatupad ng Freedom or Information o FOI na kailanman ay tila hindi sumagi sa mga nakaraang administrasyon.
Sa isang statement ng nakaraang taon na ipinaliwang ni Presidential Communications Secretary Martin Andanar noong 2016 ang halaga at kagandahan ng nasabing FOI. (news.abs-cbn.com)
“Every Filipino shall have access to information, official records, public records and paper pertaining to official acts, transactions or decisions as well as government research data used as basis for public development. Local government units are encouraged to observe and be guided by this order. ..No request for information shall be denied unless it legally falls under any of the exceptions.”
Sa madaling salita ay mapapalagay ang mamamayang Pilipino na sa mabuting mga proyekto at gawain napupunta ang mga buwis na kanilang ibinabayad dahil maging ang bidding sa mga proyekto ay napakadali ng i-access.
Isa itong napakagandang EO na nilagdaan ng Pangulo upang matiyak na walang kalokohan na ginagawa ang mga government officials na under ng Executive branch.
Ngunit, sa kabilang dako naman ay tila hirap na hirap at tila walang balak ang legislative at judiciary branch ng gobyerno na madaliin ang pagsulong ng FOI.
Kaya naman muling binuksan ng Pangulo ang tungkol sa topic na ito.
Ayon naman kay Presidential Communications Operations Office (PCOO) Assistant Secretary Kris Ablan: “We have actually talked with our FOI champions in the Senate and in the House of Representatives and they have promised that hopefully, after the passage of the tax reform bill, as well as the budget for next year, the next bill to be tackled by the Congress is the FOI law.”
Ngunit, nakapagtataka lamang na bakit tila inabot pa ng mahigit isang taon bago naging tila bukas ang Senado sa posibilidad na ito at tila aabutin na naman ng ilang buwan o kaya ay taon bago mapag-usapan ito sa Senado.
Ayon sa foi.gov.ph, “Informations, official records, public records, and documents and papers pertaining to official acts, transactions or decisions, as well as to government research data used as basis for policy development.” Ang maaaring makuha o madaling malaman ng mamamayan dahil sa Executive Order No. 2 series of 2016 na ito.
Sana lamang ay maunawaan ito ng legislative at judicial branch ng gobyerno at madaliin na ang pagpapasa ng nasabing FOI upang mapanatag na rin ang mga Pilipino sa kaalamang alam nila ang bawat galaw at desisyon ng mga opisyal at opisina ng gobyerno.
